Scope and purpose of the collection, processing, and use of personal data
What personal data we collect
We may collect master data (e.g., company name, name, address, email, etc.), personal data about the services you have purchased, your payment transaction data, your online preferences, and your customer feedback. We use this personal data to communicate with you, to conclude and process transactions with you, to operate the technology, for billing, market research, and marketing, such as to analyze our customer base or to contact you by mail, email, or text message.
We may collect personal data about your creditworthiness in order to protect ourselves against payment defaults.
Your surfing and usage data will then be collected. This includes, for example, your IP address, information about which device, browser, and browser version you used to visit the technology, when you visited it, which operating system you use, from which website or app you accessed our technology via a link, and which elements of the technology you use and how. This personal data is stored together with the IP address of your access device. It is used to display our technology correctly, to optimize it, to protect it against attacks or other legal violations, and to personalize the technology for you.

This data is collected and processed for the purpose of enabling the use of our website (connection establishment), ensuring system security and stability in the long term, enabling the optimization of our Internet offering, and for internal statistical purposes. This constitutes our legitimate interest in data processing. The IP address is used in particular to determine the country of residence of the website visitor. Furthermore, the IP address is used in the event of attacks on the network infrastructure of www.hofweissbad.ch, evaluated for statistical purposes. Use of your data for advertising purposes
Creation of pseudonymized user profiles
In order to enable personalized marketing on social networks, we use so-called remarketing pixels on our technology. If you have an account with a social network included in this and are logged in there at the time of your visit to the site, this pixel links the site visit to your account. You can make further settings for advertising in the respective social networks in your user profile. We use re-targeting technologies. This involves analyzing your user behavior on our technology in order to subsequently offer you advertising tailored to your individual interests on partner websites. Your user behavior is recorded pseudonymously. Most retargeting technologies work with cookies. You can prevent retargeting at any time by rejecting or disabling the relevant cookies in the menu bar of your web browser. You can also do this via the Digital Advertising Alliance website at optout.aboutads.info request an opt-out for the aforementioned additional advertising and re-targeting tools.
The following remarketing pixels are used on the technology:
Google Tag Manager
We also use Google Tag Manager to manage services for usage-based advertising. The Tag Manager tool itself is a cookie-free domain and does not collect any personal data. Rather, the tool triggers other tags, which may collect data (see above). If you have disabled cookies at the domain or cookie level, this will remain in effect for all tracking tags implemented with Google Tag Manager.
Adwords and Doubleclick
We use Google AdWords Remarketing and Doubleclick by Google, services provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"), to place ads based on the use of previously visited websites. Google uses the so-called DoubleClick cookie for this purpose, which enables your browser to be recognized when you visit other websites. The information generated by the cookie about your visit to this technology (including your IP address) is transmitted to a Google server in the USA and stored there (for information on the transfer of personal data to the USA, please see "Transfer of personal data abroad" below). Google will use this information to evaluate your use of the technology in relation to the advertisements to be displayed, to compile reports on website activity and advertisements for website operators, and to provide other services related to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. However, Google will not associate your IP address with any other data held by Google.
Transfer of data to third parties
We will pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the relationship between you and Hotel Hof Weissbad (e.g. collection agencies, authorities, or lawyers). We pass on your data to third parties to the extent that this is necessary in connection with the use of the technology for the provision of the services you have requested (e.g., outsourcing partners; hosters; companies with whom we offer the services on our technology (e.g., for bookings, rentals, purchases, etc.); companies that advertise on our behalf) and the analysis of your user behavior.
When passing on data to third parties, we ensure that there are sufficient contractual guarantees that such third parties will use the personal data in accordance with the legal requirements and exclusively in our interest.
If the technology contains links to third-party websites, Hotel Hof Weissbad has no influence on the collection, processing, storage, or use of personal data by the third party after clicking on these links and accepts no responsibility for this.
Data processor
We use external service providers (processors), e.g. for shipping goods, newsletters, online bookings, vouchers, or payment processing. A separate data processing agreement has been concluded with the service provider to ensure the protection of your personal data. We work with the following service providers:
- HotelNetSolutions GmbH, Genthiner Strasse 8, DE-10785 Berlin (Online Booking CBooking) www.hotelnetsolutions.de
- Idea Creation GmbH, Walchestrasse 15, CH-8006 Zurich (E-GUMA voucher tool), www.e-guma.ch
- Hostpoint AG, Neue Jonastrasse 60, CH-8640 Rapperswil-Jona, www.hostpoint.ch
- MailChimp, The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA
Transfer of personal data abroad
Hotel Hof Weissbad is entitled to transfer your personal data to third-party companies (contracted service providers) abroad, provided that this is necessary for the data processing described in this privacy policy. These companies are subject to the same data protection obligations as we are. If the level of data protection in a country does not correspond to that in Switzerland or the EU, we will ensure by contract that the protection of your personal data corresponds to that in Switzerland or the EU at all times.
For the sake of completeness, we would like to point out to users with their place of residence or registered office in Switzerland that surveillance measures exist in the USA that generally enable the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA. This is done without differentiation, restriction, or exception based on the purpose pursued and without an objective criterion that would allow the US authorities' access to the data and its subsequent use to be limited to specific, strictly defined purposes that justify the interference associated with both access to and use of this data. We also point out that there are no legal remedies available in the US for data subjects from Switzerland that would allow them to obtain access to the data concerning them and to have it corrected or deleted, nor is there any effective judicial protection against general access rights of US authorities. We expressly inform the data subjects of this legal and factual situation so that they can make an informed decision about consenting to the use of their data. We would like to point out to users residing in an EU member state that, from the perspective of the European Union, the US does not have an adequate level of data protection, among other things due to the issues mentioned in this section. As we have explained in this privacy policy that recipients of data (such as Google, Facebook, or LinkedIn) are based in the US, we will either ensure through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-US Privacy Shield that your data is protected at an adequate level by our partners.
Data
We use appropriate technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss, and unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. You should always treat your information as confidential and close the browser window when you have finished communicating with us, especially if you share your computer with others. We also take internal data protection very seriously. Our employees and the service providers we commission are bound by confidentiality and compliance with data protection regulations.
Cookies
We use cookies in our technology. Cookies help in many ways to make your visit to our website easier, more enjoyable, and more meaningful. Cookies are information files that your web browser automatically stores on your computer's hard drive when you visit our website.
Session cookies are used to assign information stored on the server to you or your Internet browser during a specific visit to our website (e.g. in the online shop) so that you can clearly be identified each time you visit (e.g. so that the contents of your shopping cart are not lost). Session cookies are deleted when you close your Internet browser. Permanent cookies are used to store your preferences (e.g., preferred language) across multiple independent visits to our website, i.e., even after you close your Internet browser, or to enable automatic login. Permanent cookies are only deleted in accordance with your Internet browser settings (e.g., one month after your last visit). By using our website and the corresponding functions (e.g., language selection or autologin), you consent to the use of permanent cookies.
Cookies do not damage your computer's hard drive, nor do they transmit personal data about users to us. We use cookies, for example, to better tailor the information, offers, and advertising displayed to you to your individual interests. Their use does not result in us receiving new personal data about you as an online visitor. Most Internet browsers automatically accept cookies. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears when you receive a new cookie. Deactivating cookies may mean that you cannot use all the functions of our website.
We use the consent tool "Real Cookie Banner" to manage the cookies and similar technologies (tracking pixels, web beacons, etc.) used and the related consent. Details on how "Real Cookie Banner" works can be found at https://devowl.io/de/rcb/datenverarbeitung
Tracking tools
We use tracking tools on our website. These tracking tools monitor your surfing behavior on our website. This monitoring is carried out for the purpose of designing our website in line with your needs and for its ongoing optimization. In this context, pseudonymized usage profiles are created and small text files stored on your computer ("cookies") are used.
Third-party contractors may also use permanent cookies, pixel tags, or similar technologies for this purpose. The third-party contractor does not receive any personal data from us, but may track your use of our website, combine this information with data from other websites you have visited and which are also tracked by the third-party contractor, and use this information for its own purposes (e.g., to control advertising). The processing of your personal data by the third-party contractor is then carried out under the responsibility of the service provider in accordance with its privacy policy.
The following tracking tools are used:
Social media plug-ins
The social plugins described below are used on this website. The plugins are disabled by default on our website whenever possible and therefore do not send any data. You can activate the plugins by clicking on the corresponding social media button. When these plugins are activated, your browser establishes a direct connection to the servers of the respective social network as soon as you visit one of our web pages. The content of the plugin is transmitted directly from the social network to your browser and integrated into the website. The plugins can be deactivated again with a single click.
Google
On certain pages, you will find maps that are integrated from Google Maps. Google Maps is a product of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The maps are displayed using iFrame. This means that a third-party website is accessed in that area of the website. We have no influence over data processing in this iFrame. Google will assign the access to your Google account. Google Maps will set a cookie as soon as the page is loaded. If you wish to prevent this, you can disable Google cookies for your browser using the links provided under "Opt-out/opt-in options."
Social plugins from Facebook
This website uses social plugins from Facebook to personalize our website. For this purpose, we use the "LIKE" or "SHARE" button. This is a service provided by the US company Facebook Headquarters, 1 Hacker Way, Menlo Park, California 94025 USA, telephone: 1-650-308-7300. By integrating the plugins, Facebook receives information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA and stored there. If you are logged in to Facebook, Facebook can directly associate your visit to our website with your Facebook account. If you interact with the plugins, for example by clicking the "LIKE" or "SHARE" button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends. For this purpose, Facebook creates usage, interest, and relationship profiles, e.g., to evaluate your use of our website with regard to the advertisements displayed to you on Facebook, to inform other Facebook users about your activities on our website, and to provide other services related to the use of Facebook. The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and settings options for protecting your privacy, can be found in Facebook's privacy policy.
YouTube
On certain pages, you will find films that are embedded from YouTube. YouTube is a product of YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The films are displayed using iFrame. This means that when you view the video, you are accessing a third-party website. We have no control over data processing in this iFrame. If you are logged into your YouTube account, YouTube will associate the video you view with your YouTube account. If you wish to prevent this, please log out of your YouTube account. YouTube will set a cookie as soon as the page is loaded. If you wish to prevent this, you can use the links provided under "Opt-out/opt-in options" to deactivate Google.
Disable cookies for your browser.
Evaluation of newsletter usage
We use third-party email marketing services to send our newsletter. Our newsletter may therefore contain a so-called web beacon (tracking pixel) or similar technical means. A web beacon is a 1×1 pixel invisible graphic that is linked to the user ID of the respective newsletter subscriber. This pixel is only activated when you display the images in the newsletter. The use of such services enables us to determine whether the emails containing our newsletter have been opened. In addition, the click behavior of newsletter recipients can also be recorded and evaluated. We use this data for statistical purposes and to optimize the newsletter in terms of content and structure. This enables us to tailor the information and offers in our newsletter better to the interests of our readers. The tracking pixel is deleted when you delete the newsletter. To prevent tracking pixels in our newsletter, please set your email program so that HTML is not displayed in messages.
Automated decision-making / profiling
We (or third parties commissioned by us) do not make any automated decisions that affect your personal data or have legal effects on you or significantly affect you in a similar way.
Legal basis for processing
The legal basis for the processing of personal data by us is generally found in Article 13(2)(a) of the DSG (processing in direct connection with the conclusion or performance of a contract; corresponds to Article 6(1)(b) of the EU GDPR) and in Article 13(1) of the DSG (consent of the data subject or obligation to process by law; corresponds to Article 6(1)(a) of the EU GDPR). In cases where we wish to refuse to conclude contracts with data subjects in the future due to misuse, default of payment or similar legitimate reasons, we reserve the right, based on Article 13(1) of the DSG (corresponding to Article 6(1)(f) of the EU GDPR), to store the surname, first name, address, and email address of a data subject, as well as the personal data relating to the circumstances of the case in question, in our own interest. Your personal data will also be processed by other group companies in accordance with Art. 13 para. 1 DSG (corresponds to Article 6 para. 1 letter f EU GDPR).
Your rights
Upon request, we will inform any person concerned whether and, if so, which personal data relating to them is being processed (right to confirmation, right to information). At your request:
- We waive the processing of personal data in whole or in part (right to revoke your consent to the processing of non-essential personal data; right to be forgotten). We will also inform third parties to whom we have previously forwarded your personal data of your request to be forgotten.
- we will correct the relevant personal data (right to correction)
- we restrict the processing of the relevant personal data (right to restriction of processing; in this case, we will only store your personal data or use it to protect our legal claims or the rights of another person)
- You will receive the relevant personal data in a structured, commonly used and machine-readable format (right to data portability).
To make such a request to exercise a right described in this section, for example if you no longer wish to receive email newsletters from us or wish to delete your account, please use the corresponding function on our website or contact our data protection officer or an employee as specified at the beginning of this privacy policy. If we do not comply with a request, we will inform you of the reasons for this. For example, we may refuse to delete your personal data in a legally permissible manner if your personal data is still required for the original purposes (e.g., if you are still receiving a service from us), if the processing is based on a mandatory legal basis (e.g., statutory accounting requirements), or if we have an overriding interest (e.g., in the event of a legal dispute with the data subject). If we assert an overriding interest in the processing of personal data, you still have the right to object to the processing if your particular situation outweighs our interests (right to object). This could be the case, for example, if you are a person of public interest or if the processing creates a risk that you will be harmed by third parties. If you are not satisfied with our response to your request, you have the right to lodge a complaint with a competent supervisory authority, for example in your country of residence or at the registered office of Hotel Hof Weissbad (right to lodge a complaint).
Storage of data
We only process personal data for as long as this is necessary for the respective purpose or required by law. If you have created an account with us, we will store the master data provided for this purpose indefinitely. However, you can request the deletion of your account at any time (see heading "Your rights"). We will delete the master data unless we are required to retain it by law. If you place an order without an account, your master data will be deleted after the warranty period or the end of the service, unless we are required to retain it by law. This deletion may take place immediately or as part of periodic deletion runs.
Contract data, which may also include personal data, will be stored by us until the expiry of the statutory retention period of 10 years. Data retention obligations arise, among other things, from accounting regulations and tax regulations as well as from the obligation to retain electronic communications. If we no longer need this data to perform services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.
If we wish to refuse further business contact with a data subject due to misuse, payment defaults, or other legitimate reasons, we will retain the relevant personal data for five years, or ten years in the event of a repeat offense.
Opt-out/opt-in option
If you do not agree to us evaluating your usage data, you can disable this. Tracking is disabled by placing a so-called "opt-out cookie" on your system. If you delete all your cookies, please note that the opt-out cookie will also be lost and may need to be renewed.
Please note that the list below is a list of opt-out options, which sometimes also includes trackers used by our partners that are not necessarily used on the website:
- Browser add-on to disable Google Analytics
- Disabling the DoubleClick cookie
- Disabling Quantcast targeting
